General Terms and Conditions (GTC)

Status: July 2025

1) Scope of Application

These General Terms and Conditions (GTC) of Beauty Steps GmbH (hereinafter referred to as the “Seller”) apply to all contracts for the delivery of goods concluded between the Seller and a consumer or entrepreneur (hereinafter referred to as the “Customer”) in relation to the goods displayed by the Seller in the online shop. The inclusion of the Customer’s own terms is hereby rejected unless otherwise agreed in writing.

Consumer means any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Entrepreneur means any natural or legal person or legally recognized partnership who, when entering into a legal transaction, acts in the exercise of their trade or independent professional activity.

2) Conclusion of Contract

The product descriptions in the Seller’s online shop do not constitute binding offers but merely serve as an invitation for the Customer to submit a binding offer.

The Customer can submit an offer using the integrated online order form. After placing the selected goods in the virtual shopping cart and completing the ordering process, the Customer submits a legally binding offer by clicking the button that completes the order.

The Seller may accept the Customer’s offer by:

  • sending an order confirmation via e-mail, or
  • delivering the ordered goods.
The contract shall be deemed concluded when the first of these events occurs.

 

The Seller does not store the contract text and does not provide access after completion. If the Customer has created an account before ordering, order data can be viewed via the Customer’s password-protected account.

Before confirming the order, the Customer can identify and correct possible input errors (e.g. using the browser’s zoom function) until clicking the final order button.

The contract is concluded exclusively in German.

Order processing and communication usually take place via e-mail. The Customer must provide a valid e-mail address and ensure that messages from the Seller or third parties commissioned by the Seller can be received (including configuring SPAM filters accordingly).

3) Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Details can be found in the Seller’s Withdrawal Policy (Widerrufsbelehrung).

4) Prices and Payment Terms

Unless otherwise stated, all prices are total prices including VAT. Additional delivery and shipping costs are listed separately in each product description.

For deliveries outside the European Union, additional costs such as bank transfer fees, exchange rate fees, customs duties, or import taxes may apply and must be borne by the Customer. Such costs may also occur when paying from outside the EU even if delivery occurs within the EU.

Available payment methods are displayed in the online shop.

In case of prepayment by bank transfer, payment is due immediately after conclusion of the contract unless otherwise agreed.

When choosing PayPal as the payment method, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under the PayPal User Agreement or, if the Customer does not have a PayPal account, under the Terms for Payments without a PayPal Account. The contract is concluded at the moment the Customer clicks the final order button.

When choosing Amazon Payments, payment is processed via Amazon Payments Europe s.c.a., Luxembourg, under the Amazon Payments Europe User Agreement. By clicking the final order button, the Customer simultaneously authorizes Amazon to process the payment. The Seller declares acceptance of the offer at that moment.

When choosing credit card via Stripe, the amount becomes due immediately upon conclusion of the contract. Payments are processed by Stripe Payments Europe Ltd., Dublin. Stripe reserves the right to conduct a credit check and may refuse this method if the result is negative.

5) Delivery and Shipping Conditions

Delivery is made within the area specified by the Seller to the address provided by the Customer. Once the goods have been handed to the carrier and left the warehouse, the risk passes to the Customer, even if the transport costs are borne by Beauty Steps GmbH. This applies to partial deliveries as well.

Depending on the region and shipping rates, delivery is carried out by standard carriers such as DHL or UPS. Costs are calculated according to the carrier’s rates.

Delivery times are approximate and non-binding unless expressly confirmed by Beauty Steps GmbH. Compliance depends on proper and timely self-supply. Partial deliveries are allowed if reasonable for the Customer.

If delivery fails due to reasons attributable to the Customer, the Customer bears the resulting reasonable costs. In the event of withdrawal, the conditions of the Seller’s Withdrawal Policy apply.

Force majeure, governmental orders, or other circumstances beyond Beauty Steps GmbH’s control release the Seller from delivery obligations for the duration of their effect. The Seller may withdraw from the contract if fulfillment becomes impossible; the Customer also has the right to withdraw. Statutory rights remain unaffected.

The Seller may withdraw from the contract in the event of incorrect or delayed self-supply, provided it is not the Seller’s fault and a proper procurement agreement was concluded. In case of unavailability, the Customer will be informed immediately and refunded without delay.

Self-collection is not possible for logistical reasons.

6) Retention of Title

The Seller retains ownership of the delivered goods until full payment of the purchase price has been received.

7) Liability for Defects (Warranty)

Product images may differ from the actual appearance of the delivered goods due to manufacturer updates. Minor variations that are reasonable for the Customer do not constitute a defect.

If goods are defective, the Seller shall provide supplementary performance within a reasonable period – either by rectifying the defect or providing a replacement. If the chosen option involves disproportionate cost, the Seller may choose the alternative. If rectification fails, the Customer may withdraw from the contract or demand a price reduction.

Defective goods must be returned to the Seller unless the Customer chooses a price reduction.

Consumers are advised to report visible transport damage to the carrier and inform the Seller. Failure to do so does not affect statutory rights.

8) Applicable Law

All legal relations between the parties are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this applies only to the extent that mandatory provisions of their country of residence are not overridden.

9) Place of Jurisdiction

If the Customer is a merchant, a legal entity under public law, or a special fund under public law with a registered office in Germany, the Seller’s place of business shall be the exclusive place of jurisdiction. For Customers outside Germany, this also applies if the contract or related claims are connected to their professional or commercial activity. The Seller may also bring an action before the court at the Customer’s location.

10) Alternative Dispute Resolution

The European Commission provides an online dispute resolution platform accessible at: ec.europa.eu/consumers/odr. This platform serves as a point of contact for out-of-court settlements of disputes arising from online purchase or service contracts involving consumers.

The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11) Miscellaneous

The Seller reserves the right to modify these General Terms and Conditions at any time. The latest version is always available on https://plamine.de as a downloadable and printable PDF file.
